Rolling Oaks Gunmen Formally Charged with Capital Murder

Jason Matthew Prieto, 35, was formally charged today with capital murder in connection with yesterday's bloodbath at Rolling Oaks Mall, charges that could lead to Death Row, News Radio 1200 WOAI reports. 

 Officer Doug Greene tells News Radio 1200 WOAI that the Capital Murder charge involves the shooting death of Jonathan Murphy, 42, a shopper who tried to stop Prieto and another man from leaving the Kay Jewelry at Rolling Oaks Mall after they had robbed the business. 

 A second shopper then pulled a legally carried handgun and shot at the other suspect, who is in the hospital in critical condition with a gunshot wound. 

 Greene says officers are not absolutely certain of the second suspect's identity, so he has not been formally charged year, but he will also face Capital Murder charges.

  Both men will also be charged with two counts of aggravated assault.  Prieto is charged with shooting two shoppers, a man and a woman, as he attempted to run away like a coward as his buddy lay bleeding on the floor.  

The two shoppers are in stable condition.

Murphy was pronounced dead at the scene.
